What is Trademark Registration?

Trademark registration in India secures your exclusive rights to use your brand name or logo for your goods or services under the Trade Marks Act, 1999. It provides strong legal protection against infringement — allowing you to take legal action, including seeking damages, against anyone who uses or imitates your brand without permission. Once registered, a trademark is valid for ten years from the filing date and can be renewed indefinitely, ensuring long-term brand security and recognition across India.

Frequently Asked Questions

How long does a trademark registration take in India?+
The complete trademark registration process in India typically takes 12 to 24 months, depending on whether any objections or oppositions are raised. You receive an application acknowledgement on the same day of filing, and the ™ symbol can be used immediately. The ® symbol can only be used after the final registration certificate is issued.
What is the government fee for trademark registration?+
The government filing fee via IP India is ₹4,500 per class for individuals, MSMEs, and startups, and ₹9,000 per class for companies, LLPs, and other entities. These fees are per trademark class — if you want to register across multiple product/service categories, each class requires a separate application and fee.
Can I use ™ before my trademark is registered?+
Yes. You can use the ™ (trademark) symbol as soon as your application is filed with IP India — it indicates a pending trademark claim. The ® (registered trademark) symbol can only be used legally after your trademark receives its final registration certificate from the Registry.
What is a trademark class? How do I know which class to file under?+
Trademarks are registered under specific Nice Classification classes (1 to 45), which categorise different types of goods and services. For example, clothing falls under Class 25, software under Class 42, and restaurant services under Class 43. Our experts will identify the correct class(es) for your business before filing.
What happens if my trademark application is objected to?+
If the Trademark Registry examiner raises an objection, they issue an Examination Report. You must file a written response (and sometimes appear for a hearing) within 30 days. CapitalBox assists with drafting and filing the examination response to maximise chances of overcoming the objection.
For how long is a trademark valid? What is the renewal process?+
A registered trademark is valid for 10 years from the date of filing. It can be renewed indefinitely for successive 10-year periods by paying the renewal fee. Renewal can be filed 6 months before expiry. If you miss the renewal deadline, there is a 6-month grace period with an additional surcharge. After that, the trademark is removed from the register.
Does CapitalBox's fee cover objection responses and hearings?+
The ₹2,999 fee covers search, application drafting, and filing. Examination response drafting and hearing representation are available as separate add-on services, with fees communicated transparently before you proceed. You are never billed without prior agreement.
