2CapitalBox Consultancy Fee
The consultancy fee of ₹3,000 + GST is CapitalBox's fixed professional fee for trademark renewal facilitation. It is payable at the time the customer initiates the service and is separate from, and in addition to, the statutory government renewal fee described in Section 3.
The fee covers:
Verification of the trademark's current status, class(es) and renewal due date on the IP India register
Preparation of the renewal application (Form TM-R) and, where applicable, an updated Power of Attorney (Form TM-48)
Filing of the renewal application on the IP India portal and obtaining the filing acknowledgement
Application status tracking until the renewal is recorded against the trademark
The consultancy fee covers renewal filing support only. If the trademark's proprietor details have changed since the last filing, recording an assignment (Form TM-P) is a separate add-on service and must typically be completed before the renewal can be processed.
3Government Renewal Fee
In addition to the CapitalBox consultancy fee, a statutory government renewal fee is payable to IP India, per trademark class being renewed. Unlike the fee for a fresh registration, the renewal fee does not carry a concessional rate for individuals, MSMEs or startups — it applies uniformly per class, per mark.

4Renewal Timeline & Deadlines
A registered trademark is valid for 10 years from the date of registration. Renewal must be filed to keep the mark in force, and the process can be initiated well before the expiry date.

5Refund & Cancellation
The CapitalBox consultancy fee is non-refundable once status verification or drafting of the renewal application has commenced, as it represents the cost of professional work already rendered, irrespective of the timeframe in which the Registry records the renewal.
The government renewal fee, once paid to IP India, is governed by IP India's own refund policy and is not refundable by CapitalBox. If a customer wishes to withdraw a request before filing has begun, they may request cancellation in writing; any refund in such cases, if applicable, shall be at the sole discretion of CapitalBox.

7Customer Responsibilities
The customer is responsible for providing accurate registration details, including the trademark's application/registration number, class(es), and current proprietor details, and for confirming these against the IP India register. CapitalBox relies on the information provided by the customer and is not responsible for any delay, discrepancy, or rejection arising from incomplete, incorrect, or outdated information furnished by the customer.
The customer is also responsible for initiating the renewal request with sufficient time before the expiry date, and for promptly signing and returning any updated Power of Attorney or authorisation documents required for filing.
8Data & Privacy
Personal, brand and registration information shared by the customer will be used by CapitalBox solely for the purpose of verifying trademark status and preparing and filing the renewal application, and may be submitted to IP India as necessary to process the renewal. CapitalBox takes reasonable measures to protect customer data in accordance with applicable law, including the Digital Personal Data Protection Act, 2023.
9Limitation of Liability
CapitalBox shall not be liable for any loss, damage, or claim arising from delay in processing by IP India, removal of the trademark from the register due to a missed deadline that was not communicated to CapitalBox in time, or any act or omission of IP India. CapitalBox's liability, where applicable, shall in no event exceed the amount of the consultancy fee actually paid by the customer to CapitalBox for the specific service in question.

Applies because the customer is availing a paid service (renewal facilitation) from CapitalBox, making them a "consumer" under law. This Act protects customers against unfair trade practices and deficiency in service, and gives them the right to approach a Consumer Forum if the facilitation service is not delivered as promised.
Applies because the entire renewal process — application submission, document upload, digital communication, and online fee payment through the IP India portal — happens electronically. This Act gives legal recognition to electronic records, digital signatures, and online transactions.
Applies because CapitalBox collects and processes personal and business data of the proprietor (identity proof, registration details) for filing with IP India. This Act regulates how such personal data must be collected, used, stored, and protected, and requires CapitalBox to obtain consent and safeguard the data against misuse.
Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts at the location of CapitalBox's registered place of business.
13Amendments to These Terms
CapitalBox reserves the right to update or modify these terms, fees, or the scope of services at any time, including in response to changes in IP India's fee schedule or filing procedures. Any material changes will be communicated through the website or other official channels, and continued use of the services after such changes constitutes acceptance of the updated terms.

By applying for services, the customer confirms that they have read and understood these terms, agrees to the applicable consultancy fee and government renewal fee set out above, and authorizes CapitalBox to verify status and to draft, file and track the renewal application on their behalf.
