2CapitalBox Consultancy Fee
The consultancy fee of ₹12,350 + GST is CapitalBox's fixed professional fee for trademark registration facilitation. It is payable at the time the customer initiates the service and is separate from, and in addition to, the statutory government filing fee described in Section 3.
The fee covers:
Consultation and brand assessment, including a distinctiveness and conflict-risk review
Preliminary trademark search on the IP India database
Selection of the correct Nice Classification class(es) for the applicant's goods or services
Drafting of the trademark application (Form TM-A), Power of Attorney (Form TM-48) and the goods/services description
Filing of the application on the IP India portal and obtaining the acknowledgement with application number
Application status tracking through examination, publication and opposition stages
The consultancy fee covers search, drafting and filing only. Drafting an examination-report response or representing the applicant at a hearing, if an objection is raised, is available as a separate add-on service with the fee communicated in advance.
3Government Filing Fee
In addition to the CapitalBox consultancy fee, a statutory government filing fee is payable to IP India, per trademark class applied for. This fee is fixed by the Government and is not retained by CapitalBox; it is paid on the applicant's behalf as part of filing the application.

4Refund & Cancellation
The CapitalBox consultancy fee is non-refundable once the trademark search has commenced or the application has been drafted, as it represents the cost of professional work already rendered, irrespective of whether the Registry ultimately accepts, objects to, or refuses the application.
The government filing fee, once paid to IP India, is governed by IP India's own refund policy and is not refundable by CapitalBox. If a customer wishes to withdraw a request before the search or drafting has begun, they may request cancellation in writing; any refund in such cases, if applicable, shall be at the sole discretion of CapitalBox.

6Customer Responsibilities
The customer is responsible for providing accurate, complete and truthful information, including the correct description of goods or services and a genuine right to use the brand name, logo, or symbol being applied for. CapitalBox relies on the information provided by the customer and is not responsible for any delay, objection, opposition, or refusal arising from incomplete, incorrect, or misleading information or documents furnished by the customer.
The customer is also responsible for signing and returning the Power of Attorney (Form TM-48) and other authorisation documents in a timely manner, and for responding promptly if an examination report or hearing notice is received from the Registry.
7Data & Privacy
Personal, brand and business information shared by the customer will be used by CapitalBox solely for the purpose of the trademark search, application drafting and filing, and may be submitted to IP India as necessary to process the application. CapitalBox takes reasonable measures to protect customer data in accordance with applicable law, including the Digital Personal Data Protection Act, 2023.
8Limitation of Liability
CapitalBox shall not be liable for any loss, damage, or claim arising from the objection, opposition, or refusal of a trademark application by the Registry, delay in examination or publication, or any act or omission of IP India or a third-party opponent. CapitalBox's liability, where applicable, shall in no event exceed the amount of the consultancy fee actually paid by the customer to CapitalBox for the specific service in question.

10Grievance Redressal

It applies because the moment a customer pays the consultancy fee and agrees to these terms, a valid contract is formed — this Act defines how that agreement is made, what makes it enforceable, and what happens if either party fails to honour its obligations (breach of contract).
Applies because the customer is availing a paid service (trademark facilitation) from CapitalBox, making them a "consumer" under law. This Act protects customers against unfair trade practices, misleading claims about registration chances, and deficiency in service, and gives them the right to approach a Consumer Forum if the facilitation service is not delivered as promised.
Applies because the entire filing process — application submission, document upload, digital communication, and online fee payment through the IP India portal — happens electronically. This Act gives legal recognition to electronic records, digital signatures, and online transactions, and governs matters like data security and electronic contract validity.

Any material changes will be communicated through the website or other official channels, and continued use of the services after such changes constitutes acceptance of the updated terms.

By applying for services, the customer confirms that they have read and understood these terms, agrees to the applicable consultancy fee and government filing fee set out above, and authorizes CapitalBox to conduct the trademark search and to draft, file and track the application on their behalf.
