CapitalBox provides Business Loan & Funding Facilitation Services to assist customers with loan application support, documentation guidance, and coordination with Bank/NBFC partners.
CapitalBox acts solely as a facilitator and intermediary between the customer and Bank/NBFC/financial institution partners for the purpose of business loan and funding applications. CapitalBox is not a bank, non-banking financial company (NBFC), or lender, and does not sanction, underwrite, or disburse any loan itself.
The role of CapitalBox is limited to assisting the customer in identifying a suitable funding option, preparing and organising the required documentation, and coordinating the application with the relevant lending partner on the customer's behalf. Engaging CapitalBox's services does not guarantee loan approval, a specific interest rate, or any particular loan amount.
2Application Activation Fee
The activation fee of ₹1,100 is payable at the time the customer initiates the loan facilitation process, before the application is forwarded to any Bank/NBFC partner. This is a one-time, non-refundable processing fee that covers the initial work undertaken by CapitalBox regardless of the eventual outcome of the loan application.
The fee specifically covers:
Application processing support, including creation and management of the customer's loan application file
Requirement assessment, to understand the customer's funding need, business profile and eligibility
Document guidance, including a checklist and review of KYC, business and financial documents
Loan application assistance, including formatting and submission support for the chosen lender
Coordination support between the customer and the lending partner during initial processing
The activation fee is charged for the facilitation effort itself and is payable irrespective of whether the loan application is subsequently approved, rejected, or withdrawn.
3Success Facilitation Fee
A success facilitation fee of 2% of the sanctioned loan amount becomes payable only after the loan has been successfully sanctioned by the lending partner and the sanctioned amount, or the first tranche of it, has been disbursed to the customer.
This fee is calculated on the sanctioned loan amount (not the amount applied for, if different) and is due at the time of disbursement, unless otherwise communicated in writing by CapitalBox. In the case of loans disbursed in tranches, CapitalBox may raise the success fee proportionately against each tranche or as a single amount against the total sanctioned limit, depending on the nature of the facility.
This fee is charged on successful outcomes only. No success fee is payable if the loan application is rejected by the lender, or if the customer withdraws the application before sanction, or if sanction is granted but disbursement does not take place.
4Refund & Cancellation
The Application Activation Fee is non-refundable once the application has been initiated and processing has commenced, as it represents the cost of services already rendered by CapitalBox, irrespective of the final loan decision by the lender.
If a customer wishes to withdraw an application before it has been submitted to any lending partner, they may request cancellation in writing; any refund in such cases, if applicable, shall be at the sole discretion of CapitalBox and may be subject to a deduction towards work already performed.
5Important Information
CapitalBox is a loan facilitation and consultancy service provider and does not provide loans directly. All lending decisions rest exclusively with the Bank, NBFC, or financial institution to which the application is submitted.
Final loan approval, interest rate, tenure, processing charges, and disbursement decisions are made solely by the respective Bank/NBFC or financial institution, based on their own internal policies, credit assessment, and eligibility criteria. CapitalBox has no control over, and makes no assurance regarding, these outcomes.
Customers are advised to independently review the terms, interest rate, and charges offered by the lender before accepting any loan offer facilitated through CapitalBox.
6Customer Responsibilities
The customer is responsible for providing accurate, complete and truthful information and documentation for the purpose of the loan application. CapitalBox relies on the information provided by the customer and is not responsible for any delay, rejection, or adverse outcome arising from incomplete, incorrect, or misleading information or documents furnished by the customer.
The customer is also responsible for reviewing and understanding any loan agreement, sanction letter, or terms issued directly by the lending Bank/NBFC before signing or accepting the same.
7Data & Privacy
Personal, business and financial information shared by the customer will be used by CapitalBox solely for the purpose of processing the loan facilitation request and may be shared with relevant Bank/NBFC partners as necessary to process the application. CapitalBox takes reasonable measures to protect customer data in accordance with applicable law, including the Digital Personal Data Protection Act, 2023.
8Limitation of Liability
CapitalBox shall not be liable for any loss, damage, or claim arising from the rejection of a loan application, delay in processing, changes in interest rates or lending policy, or any act or omission of the Bank/NBFC or financial partner. CapitalBox's liability, where applicable, shall in no event exceed the amount of fees actually paid by the customer to CapitalBox for the specific service in question.
9Fair Practices Code
In line with the spirit of RBI's Fair Practices Code for lenders and loan facilitators, CapitalBox commits to the following standards while assisting customers with their loan applications:
All fees, charges and the basis of calculation are disclosed upfront, in writing, before the customer makes any payment
No customer is pressured, misled, or coerced into applying for a loan product that does not suit their stated requirement
Customer information is used only for the purpose of loan facilitation and is not sold or shared for unrelated marketing purposes
Genuine complaints are acknowledged and addressed within a reasonable and communicated timeframe
Communication with customers is conducted in clear, simple language, avoiding misleading claims about approval chances, interest rates, or processing timelines
This Code reflects CapitalBox's own service commitment as a facilitator. It is separate from, and does not substitute, the Fair Practices Code that the lending Bank/NBFC is independently required to follow under RBI regulations.
10Grievance Redressal
In case of any concern, complaint, or dispute relating to the services rendered by CapitalBox, customers may raise the matter through the official contact channels provided by CapitalBox. CapitalBox will endeavour to acknowledge and address genuine grievances within a reasonable timeframe.
11Legal Compliance & Governing Law
Services are provided under, and this document is governed by, applicable Indian laws. The relevance of each law to CapitalBox's loan facilitation services is explained below:
Indian Contract Act, 1872
Governs the contractual relationship between CapitalBox and the customer. It applies because the moment a customer pays the Application Activation Fee and agrees to these terms, a valid contract is formed — this Act defines how that agreement is made, what makes it enforceable, and what happens if either party fails to honour its obligations (breach of contract).
Applies because the customer is availing a paid service (loan facilitation) from CapitalBox, making them a "consumer" under law. This Act protects customers against unfair trade practices, misleading claims about services, and deficiency in service, and gives them the right to approach a Consumer Forum if the facilitation service is not delivered as promised.
Applies because the entire application process — form submission, document upload, digital communication, and online fee payment — happens electronically. This Act gives legal recognition to electronic records, digital signatures, and online transactions, and governs matters like data security, unauthorized access, and electronic contract validity.
Applies because CapitalBox collects and processes sensitive personal and financial data of the customer (PAN, Aadhaar, bank statements, income details) for sharing with Bank/NBFC partners. This Act regulates how such personal data must be collected, used, stored, and protected, and requires CapitalBox to obtain consent and safeguard the data against misuse.
Applies because the actual loan is sanctioned and disbursed by a Bank or NBFC that is regulated by the Reserve Bank of India. While CapitalBox itself is not a lender, facilitation activity is carried out in line with RBI's fair-practice expectations for loan sourcing and referral, since the underlying credit facility is governed by these laws.
Applies because collecting KYC documents (PAN, Aadhaar, address proof) as part of the loan application is a legal requirement under India's anti-money-laundering framework. This Act is why identity verification is mandatory before an application can be forwarded to any lending partner.
Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts at the location of CapitalBox's registered place of business.
12Amendments to These Terms
CapitalBox reserves the right to update or modify these terms, fees, or the scope of services at any time. Any material changes will be communicated through the website or other official channels, and continued use of the services after such changes constitutes acceptance of the updated terms.
